Who provides the service

Cargoway is provided by Mario Cruz Ávila, NIF 50770013C, Calle Chequia, 3, 45200 Illescas (Toledo), Spain. Contact: info@cargoway.app.

Acceptance

By using Cargoway you accept these terms. If you do not agree with them, do not use the app.

What Cargoway is, and what it is not

Cargoway is a planning aid. It calculates routes for your vehicle and, in trip mode, follows your position on the map, but it does not give turn-by-turn guidance and it does not replace the judgement of a professional driver.

Routes and restrictions are guidance, not a guarantee

This is the most important clause in this document. Please read it.

  • Routes are computed from OpenStreetMap open data. A bridge height, a weight limit or a tunnel restriction may be missing, outdated or wrong in that data.
  • Road signs always prevail over anything the app shows. If the sign and the screen disagree, the sign is right.
  • The driving time and rest calculation is an aid for planning under Regulation (EC) 561/2006. It does not cover weekly or fortnightly limits, weekly rest, crew driving or work other than driving. Your tachograph is the legal record, not this app.
  • You remain solely responsible for complying with traffic law, with the restrictions applicable to your vehicle and its load, and with driving and rest time rules.

Transport documents

Cargoway helps you prepare and keep transport documents (the Spanish DeCA, the CMR and the documents of other countries) and related records. When you use it:

  • The document is made from the data you enter. You are responsible for that data being true and complete, and for using the document your transport legally requires. Which document the app suggests is guidance.
  • Signatures drawn on screen are not advanced or qualified electronic signatures. The PDF works as proof, like a paper document, but it is not an electronic consignment note under the CMR Additional Protocol (e-CMR) nor an eFTI platform.
  • Anyone with the document’s link or QR can download its PDF, because the law requires inspectors and your customer to be able to. Share it only with those who need it. It is served for 13 months and then deleted; keeping your own copy for as long as the law requires of you is your responsibility.
  • For the data of your customers and carriers (names, tax IDs, addresses, signatures) you are the controller and we act as your processor under Article 28 GDPR: we process it only to make, keep and show your documents and your address book, as you instruct through the app; we keep it confidential and in the EU; we delete it when you delete it or your account; and we help you answer requests from those people.
  • The cabotage counter, the SENT, UIT and AT checker, the tax ID check, the country notices and the waiting-time claim are aids based on the rules as of October 2026, which change. They do not replace what the authority, your customer or a professional tells you, and codes such as SENT, UIT or AT are declared by whoever the law says, not by Cargoway.

Account and eligibility

Calculating routes requires an account. You must be at least 18 years old and use the app for professional or personal transport purposes. You are responsible for keeping your account secure, and for everything done through it.

Acceptable use

You agree not to:

  • Use the service in a way that circumvents the free tier limits, or that generates automated traffic.
  • Extract, resell or redistribute the route data the app produces as if it were your own service.
  • Reverse engineer the app to obtain the credentials of the services it uses.

Free tier and paid plans

The free plan includes a limited number of routes and route analyses per day and shows ads. Cargoway Pro is a monthly or yearly subscription billed through the App Store or Google Play. It renews automatically unless you cancel it at least 24 hours before the end of the current period, and you manage or cancel it from your store account. Deleting your Cargoway account does not cancel it. Refunds follow the policy of the store you bought from, not ours.

Subscribing on the web

Cargoway Pro can also be bought at cargoway.app, paying by card through Stripe. In that case, instead of the store rules above, these apply:

  • Price and VAT — Prices include VAT, which Stripe calculates from your billing country. If you buy as a business with a valid VAT number from another EU country, the invoice has no VAT (reverse charge). The card payment is processed by Stripe; we never see your card details.
  • Renewal and cancellation — The subscription renews automatically at the end of each period until you cancel it. You can cancel it at any time from «Manage my web subscription» at cargoway.app/pro.html, and you keep Pro until the end of the period already paid.
  • Right of withdrawal — If you are a consumer in the European Union you may withdraw within 14 days of the purchase, without giving a reason, by writing to info@cargoway.app. Because you asked for Pro to start immediately, we will refund what you paid minus the part corresponding to the days already used.
  • Refunds — Apart from withdrawal, a period that has already started is not refunded, except where the law requires it.
  • Account — Pro is linked to the account you sign in with (Google or Apple): use the same one in the app. Deleting your Cargoway account cancels a web subscription immediately, without refunding the current period except under the right of withdrawal; one bought in the App Store or Google Play is not cancelled and must be cancelled there.

Withdrawal form

To withdraw from a web subscription you can write to info@cargoway.app in your own words or use this model form. You only need to fill it in and send it if you want to withdraw from the contract.

Map data and attribution

Route calculation and geographic data come from OpenStreetMap and openrouteservice, and are used under their licences. Map data is © OpenStreetMap contributors, available under the Open Database License. The map on the route preview is provided by Google Maps and is subject to Google’s terms.

Availability

We try to keep Cargoway working, but we do not guarantee it will be available without interruption. It depends on third-party services that may fail, change or disappear. The app is provided as is, without warranties of any kind.

Limitation of liability

To the fullest extent permitted by law, we are not liable for fines, delays, damage to vehicle or cargo, or any other loss arising from decisions taken on the basis of the app. Nothing in these terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence.

Termination

You can stop using Cargoway and delete your account at any time from My profile → Account options. We may suspend an account that breaches these terms.

Governing law

These terms are governed by Spanish law. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live.

Changes

We may update these terms. If a change is substantial we will announce it inside the app before it takes effect.
